Merchandise at home parties are legal when the products
sold are either real designer made (which you will never
see anywhere but in retail stores) or big brand names
you see in department stores. In addition to those
labels, you can also sell a large number of lesser-known
brands that are great quality and reflect today’s
fashions for a fraction of the price of a real designer
product. That being said, it's important to remember
that these designers don't sell their products to just
anyone and only distributors who have been through the
stringent licensing process can sell designer products
to you.
It's the consultant’s job to not only purchase the best
merchandise for their buyers but to also determine
whether a wholesaler is genuine or passing off
counterfeit merchandise. If you don't do this, or you
knowingly purchase a counterfeit purse, there can be
many repercussions for you and for your party guests. No
wonder women ask themselves, are purse parties illegal?

Why are some purse parties illegal? Selling “fake”
products may seem like a victimless crime but in fact,
it's not. There are many aspects of counterfeiting from
manufacturing to the moment the merchandise is placed in
your hands. Since most fake products are being
manufactured in other countries, smuggling has become
the main way for these fakes to get into Canada and the
United States. That’s right, the minute you purchase a
counterfeit or fake; you've been involved in smuggling.
Both Canada and the US frown on this practice and have
begun a crack-down on smuggling counterfeit products.
For this reason, they've begun to target the home
parties since there have been hundreds of thousands of
people who have made the unethical choice to buy
counterfeit.
Manufacturers and distributors of fake products can be
prosecuted under state and federal law in Canada and the
United States for violating trademark and copyright
laws. The sentence for counterfeit crimes varies widely
depending on the quantity and the value of the goods,
but can be very serious. In June 2004, 17 defendants
charged with international counterfeit trafficking in
New York faced a maximum sentence of 10 years in prison
and a maximum fine of $2 million.
Sellers and distributors are liable even if they tell
customers that the handbags are counterfeit. Moreover,
manufactures and sellers of counterfeit handbags may
also be sued in a civil suit by the designer whose
trademark is being infringed upon.
Immigration and customs enforcement officials have an
increasing interest in the trafficking of counterfeit
handbags since 9-11. According to government officials,
international terrorist networks rely on money coming
from the sale of counterfeit products such as knock-off
CDs, movies, T-shirts and drugs. And while no direct
link has been established between counterfeit products
such as jewelry or fashion handbags and terrorist
organizations, they believe that a potential link is
there. Consequently, law enforcement officials have
become increasingly active in local raids in an attempt
to trace the money and activity to international
terrorist organizations in other countries.
